These Terms of Service ("Terms") govern the relationship between Los Angeles Rendering ("we," "us," or "our") and any client ("you" or "Client") who engages us for architectural 3D rendering and visualization services. By placing an order or proceeding with a project, you agree to these Terms.
1. Scope of Services
Los Angeles Rendering provides architectural 3D rendering services including interior rendering, exterior rendering, 3D floor plan visualization, and aerial rendering. The specific deliverables, scope, number of views, revision rounds, and delivery timeline for each project are agreed upon in writing (email or project proposal) prior to commencement of work.
Any scope changes requested after project commencement may be subject to additional fees and revised timelines, which we will communicate and confirm before proceeding.
2. Project Agreement and Approval
A project begins when both parties have agreed in writing on the scope, price, and timeline. We will not commence production until we have received your approval of the project scope and any required deposit.
You are responsible for providing accurate and complete source materials (drawings, plans, specifications, reference images) in a timely manner. Delays in providing required materials may affect the agreed delivery timeline, for which we will not be held responsible.
3. Revisions
Every project includes 3 revision rounds at no additional cost, subject to the following conditions:
- Revisions must be based on the approved project scope. Requests that represent a change in project scope (e.g., a new camera angle not in the original brief, a complete redesign of the space) may be treated as a new or expanded scope and priced accordingly.
- Each revision round must be submitted as a consolidated list of changes. Multiple separate messages requesting individual changes may be combined into a single revision round at our discretion.
- Revisions are processed in the order received. Rush revision processing may be available for an additional fee.
4. Intellectual Property
Client materials. You represent that you have all necessary rights to the architectural drawings, design files, and reference materials you provide to us. You grant us a limited license to use these materials solely for the purpose of producing your rendering deliverables.
Deliverables. Upon receipt of full payment, we assign to you full ownership of the final rendered images produced for your project. You may use these images for any purpose, including but not limited to marketing, permit applications, publication, and sale.
Portfolio rights. Unless you have requested an NDA or otherwise instructed us in writing, we reserve the right to use project renders in our portfolio and marketing materials. If confidentiality is required, please indicate this at project inception and we will sign an NDA before proceeding.
5. Payment Terms
Payment terms for each project are specified in the project proposal or invoice. Standard terms are:
- Deposit: 50% of the project fee is due before production begins on projects over $500.
- Final payment: The remaining balance is due upon delivery of approved final files.
- Small projects: Projects under $500 may require payment in full before production begins.
We accept payment by credit card, bank transfer (ACH), and other methods as specified on the invoice. Final deliverables will not be released until payment has cleared in full.
Late payment. Invoices not paid within 14 days of the due date may incur a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend work on any active projects in the event of overdue invoices.
6. Cancellation
If you cancel a project after production has begun:
- Any deposit paid is non-refundable if work has commenced.
- If work is more than 50% complete at the time of cancellation, you will be invoiced for the percentage of work completed.
- Work product completed up to the cancellation date will be delivered upon payment of all outstanding amounts.
7. Delivery and Timelines
Delivery timelines are agreed upon in writing for each project. We commit to the agreed delivery date, and if we are unable to meet it due to circumstances within our control, we will notify you promptly and provide a revised timeline.
Timeline commitments are contingent on timely receipt of all required materials from the client. Delays caused by late material delivery, delayed revision feedback, or scope changes are not our responsibility and may require a revised timeline.
8. Confidentiality
We treat all client project materials as confidential by default. We will not share, publish, or disclose your project files, drawings, or unreleased designs to any third party without your written consent. If you require a formal NDA, please request one and we will execute it before you share any project materials.
9. Limitation of Liability
Our liability for any claim arising from services provided under these Terms is limited to the amount paid by you for the specific project giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind, including but not limited to lost profits, lost business opportunities, or project delays caused by third parties.
Renderings are artistic visualizations of a proposed design. Actual built results will differ from rendered images due to construction tolerances, material variations, and site conditions. We are not responsible for discrepancies between renders and finished construction.
10. Governing Law
These Terms are governed by the laws of the State of California. Any disputes arising under these Terms shall be resolved in the courts of California, and both parties consent to jurisdiction in California.
11. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of our services after such changes constitutes your acceptance of the updated Terms.
